Terms of service

These Terms and Conditions define the terms, scope and conditions of using the spacetogrow.io
website provided by Space to Grow sp. z o. o., a limited liability company, with its registered office in
Warsaw, in particular the technical terms and conditions for the provision of electronic services and the
complaint procedure.

§1. Definitions

1. Whenever the following capitalized terms are used in these Terms and Conditions, they shall be
understood as follows:
1) Knowledge base and events – includes a blog containing news related to Space to Grow
business activities and information about organized events;
2) Client – a User with whom Space to Grow has a contract for the provision of services.
3) Consumer – a natural person who performs a legal act which (i) is not directly related to his
or her trade, business or profession or (ii) is acting for purposes which are outside his or her
trade, business or profession (iii) is acting for purposes directly related to his or her trade,
business or profession, but which is not of a professional nature for him/her, resulting, in
particular, from the subject of the business activity, disclosed in the Central Register and
Information on Economic Activity (CEIDG), i.e. entrepreneur with consumer rights
(quasi-consumer);
4) Space to Grow – Space to Grow limited liability company with its registered office in Warsaw,
Żelazna 51/53 00-841 Warsaw, entered into the register of entrepreneurs of the National Court
Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial
Division of the National Court Register under the KRS No. 0001065446, share capital: 12 500
PLN, NIP: 5273082241, REGON: 52677133900000;
5) Services – the services specified in the Terms and Conditions, provided by Space to Grow to
the User, consisting of granting access to the content of the Website and its functionalities as
defined in the Terms and Conditions, delivered via electronic processing devices without the
simultaneous presence of the parties (remotely).
6) Act on Providing Services by Electronic Means – polish Act of 18 July, 2002 on Providing
Services by Electronic Means;
7) User – an entity that uses the Service, which may be a natural person with full legal capacity, a
legal person or an organizational unit that is not a legal person, to which special regulations
grant legal capacity;
8) Website – a website operated by Space to Grow at the address URL: spacetogrow.io which is
an ICT system within the meaning of Article 2(3) of the Act on Providing Services by
Electronic Means;
9) Force Majeure – any external event of an extraordinary or accidental nature, which Space to
Grow and the User have no control over or cannot prevent, including but not limited to riots,
strikes, armed conflicts, states of emergency, natural disasters, epidemics;
10) Interruption – temporary cessation of the operation of the Website or its individual subpages
or features due to technical reasons, including maintenance, updates, or repairs.
11) Terms and Conditions – these Terms and Conditions;
2. All terms defined in the Terms and Conditions have the same meaning throughout the Terms and
Conditions, regardless of their inflectional form or grammatical number.
3. All headings have been placed in the Terms and Conditions for order purposes only and do not
affect the interpretation of their provisions.

§2. General provisions

1. The owner and administrator of the Website is Space to Grow.
2. The use of the Website is free of charge and voluntary by the User with Internet access.
3. The Website is available 24 hours a day.
4. By accessing or using the Website, the User agrees to be bound by these Terms and Conditions.
5. The Terms and Conditions fulfill the obligation set out in Article 8(1)(1) and (2) of the 7) Act on
Providing Services by Electronic Means.
6. The agreement for the provision of electronic services between Space to Grow and the User is
considered effective:
1) upon entering the Website, for services related to displaying its content;
2) upon logging into an account, for services that require authentication.
7. The agreement for the provision of electronic services is terminated:
1) upon leaving the Website, for services related to displaying its content;
2) upon logging out of the account, for services requiring authentication.

§3. Objectives of the Website

1. The Website offers the following functionalities:
1) access to information about Space to Grow, including its activities, purposes, range of
services and products;
2) establishing contact with Space to Grow, including scheduling consultations;
3) subscription to the newsletter;
4) access to the Knowledge base and events;
5) information about events and webinars organized by Space to Grow, along with the option to
register;
6) exclusive Client access – only Clients of Space to Grow can log into the Website and
participate in personalized coaching sessions through the Website.
2. Access to the Website’s content and functionalities may vary depending on the User’s status.

§4. Logging in to the Website

1. Access to the login feature is exclusive to Space to Grow Clients.
2. Clients log in using a username and password.
3. Client accounts are automatically created by Space to Grow.
4. After logging in to the Website, the Client gain access to personalized coaching sessions available
through the Website.


§5. Consultations and contact

1. Users may schedule a consultation through the Website..
2. Consultations are designed to provide detailed information about the services offered by Space to
Grow, including discussions on potential collaboration, program selection, and the role of a
personal AI Coach. During the session, Users will learn about the benefits of cooperation, the
stages of service implementation, and how the offering can be customized to meet their individual
needs and expectations. Consultations are for informational purposes only and do not constitute a
binding commercial offer or professional advice.
3. Consultations are conducted as 30-minute online meetings via Google Meet. Use of the platform is
subject to Google’s Privacy Policy and Terms of Service.
4. To schedule a consultation, the User needs to:
1) select a preferred date and time;,
2) provide the following data: name, surname, e-mail address and telephone number and consent to
the processing of personal data for this purpose.
5. Details of the consultation, including the access link, will be sent to the e-mail address provided by
the User.
6. The Website also allows Users to submit their contact details to receive an offer from Space to
Grow
7. In order to submit contact details, the User needs to:
1) provide the following data:
a) name and surname;
b) email address;
c) company name;
d) phone number;
e) company size;
f) position in the company;
g) optionally – priorities and areas where Space to Grow can provide assistance,
2) give consent to be contacted.

§6. Registration and participation in webinars

1. The User may register for webinars organized by Space to Grow through the Website.
2. Both registration and participation in webinars are free of charge.
3. To register, Users must provide their first name, last name, and email address and accept the
Privacy Policy. If a phone number is provided during registration, the User will also receive an
SMS reminder about the event.
4. Upon successful registration, Users will receive a confirmation email, and no later than the day of
the webinar, a link to access the event.
5. Space to Grow reserves the right to use the e-mail address provided during registration to notify
Users of changes to the webinar schedule, updates to the Terms and Conditions, or other important
matters.
6. In order to participate in the webinar, the User should have a device and software that meets the
following minimum requirements:
1) access to a computer or compatible device with video and audio capabilities;
2) Internet access;
3) an up-to-date web browser;
4) a properly configured email account
5) speaker/headphones.
7. During the webinar, the User is strictly prohibited from sharing any unlawful content that violates
ethical standards, social norms, or common decency. This includes, but is not limited to, content
that is offensive, pornographic, incites hatred, is vulgar, false, or misleading. Additionally, Users
must not share content that contains viruses or malware, infringes on third-party rights, breaches
good moral standards, or disseminates false information that could harm the reputation of Space to
Grow.
8. Space to Grow is not responsible for any inability to access the webinar due to circumstances
beyond its control, including but not limited to technical failures, network disruptions, or
third-party interference.
9. The registration and webinar participation process relies on third-party software solutions.
10. Space to Grow does not guarantee the performance or reliability of external platforms used to host
webinars. Access to webinars may be disrupted or prevented due to unstable or insufficient
network connection, device malfunctions, power outages, or software failures, telecommunication
network disruptions, external interference or third-party actions.


§7. Newsletter

1. The User may voluntarily agree to subscribe to the Newsletter.
2. 2. The newsletter provides marketing information regarding the community, events and special
Space to Grow offers.
3. The conditions for newsletter subscription include:
1) providing the User’s name;
2) providing the e-mail address to which the newsletter is to be sent;
3) giving a consent to receive commercial information by e-mail,
4) accepting the provisions of the Privacy Policy.
4. The Newsletter is made available free of charge, for an indefinite period of time. The subscription
agreement is concluded when the User confirms their willingness to subscribe by giving consent
via the Website (single opt-in confirmation).
5. The User may unsubscribe from the newsletter at any time, without providing a reason, by either
sending an e-mail to Space to Grow at admin@spacetogrow.io or clicking the unsubscribe link
included in every newsletter email.
6. The newsletter dervice is provided by GetResponse, S.A., with its registered office in Gdańsk,
aleja Grunwaldzka 413, 80-309 Gdańsk, Poland, KRS: 000942075, NIP: 9581468984.

§8. How you use the Website

1. Users must comply with these Terms and Conditions and all applicable laws while using the
Website.
2. The User is prohibited from submitting or sharing any content that is unlawful, contrary to public
morals or social norms, unrelated to the purpose of the Website, in violation of these Terms and
Conditions, harmful to the reputation or image of any individual or Space to Grow, offensive,
misleading, false, or infringing upon the rights of third parties, including impersonation of others.
3. Extracting or harvesting content from the Website using web scraping, web parsing, or similar
automated techniques for any purpose is strictly prohibited.
4. The User is prohibited from copying, modifying, distributing, or otherwise utilizing the Website in
any way that violates these Terms and Conditions. In particular, the User must not attempt to
bypass or disable the Website’s security measures, engage in unauthorized access or actions that
could expand access privileges beyond those granted, or introduce any form of malicious software,
including viruses, worms, trojans, or unauthorized extensions, that could compromise the integrity,
security, or functionality of the Website and its data.
5. Space to Grow holds all rights to the Website, including intellectual property and copyright. All
technical solutions, graphical elements, and other components, including but not limited to HTML
code, CSS stylesheets, and JavaScript scripts, are legally protected, particularly under copyright
law, and remain the exclusive property of Space to Grow. This protection also applies to all
materials and works made available or provided to Users as part of the Services. The availability or
transfer of such materials does not constitute a grant or transfer of rights unless expressly stated
otherwise by Space to Grow.


§9. Rights and Liability of Space to Grow

1. Space to Grow is responsible for ensuring the proper operation of the Website.
2. Space to Grow reserves the right to implement technical interruptions in the operation of the
Website.
3. Space to Grow reserves the exclusive right to modify, upgrade, or update the Website, including
making changes to the content and information available on the Website.
4. Space to Grow has the exclusive right to modernize the Service, make changes or update the
information posted on the Site.
5. The User may report any technical issues or malfunctions related to the Website by contacting the
following address: spacetogrow@spacetogrow.io.
6. Space to Grow is not responsible for:
1) disruptions, malfunctions, or failures that prevent or impair access to the Website, arising in
connection with its operation;
2) non-performance or improper performance of the Agreement, if it was caused by
circumstances of a Force Majeure nature;
3) non-performance or improper performance of obligations under the agreement for the
provision of electronic services to the extent caused by the User’s failure to perform its
obligations, including, but not limited to, misuse of the Website in a manner inconsistent with
its intended purpose.


§10. Personal data

1. Space to Grow is the data controller responsible for processing personal data provided by Users.
2. Detailed information regarding the processing of personal data and the use of cookies is available
in the Privacy Policy, accessible at: spacetogrow.io/privacy-policy


§11. Technical requirements

1. In order to use the Website, it is required to meet the following minimum technical requirements:
a) possession of a terminal equipment (computer, tablet, smartphone) with access to the Internet
and use a properly configured Internet browser that allows access to the Website;
b) cookies enabled in the browser settings;
c) having a web browser: Microsoft Edge, Google Chrome, Mozilla Firefox, Safari, Opera in the
latest, current version or other mobile versions. The technical requirements of the website
refer to the latest versions of web browsers and software. Due to the continuous improvement
of the portal, the Website may not work properly on older versions of browsers.
2. Additionally, access to certain Website functionalities, including newsletter subscription,
scheduling consultations, and webinar registration, requires access to a valid email account.
3. Space to Grow will make every effort to ensure the continuous availability of the Website.
However, the company reserves the right to implement temporary service Interruptions due to
scheduled maintenance, including upgrades to hardware, system software, tools, or internet service
provider infrastructure, as well as unforeseen technical issues. If a planned service Interruption is
expected to affect normal Website access, Space to Grow will notify Users at least 24 hours in
advance by posting a notice on the Website.
4. In exceptional circumstances that may impact the security or stability of the Website, Space to
Grow reserves the right to temporarily suspend or restrict access to services without prior notice to
Users.


§12. Threats

1. Pursuant to Article 6(1) of the Act on Providing Services by Electronic Means, Space to Grow
informs that the User, like any other Internet users, they are exposed to potential risks when
accessing online services. A primary risk is the infection of their IT system by malicious software,
including viruses, worms, and Trojan horses, which are designed to compromise system security
and cause harm. To reduce these risks, the User is strongly advised to equip their devices with
up-to-date antivirus software and a firewall and to ensure regular updates.
2. Space to Grow also warns that the use of the Website carries specific risks related to cyberattacks,
including attempts by hackers to gain unauthorized access to the Website.
3. Space to Grow uses advanced security technologies to minimize the risks outlined in sections 1 and
2 of this paragraph. However, it is important to note that no security measures can provide absolute
protection against all forms of cyber threats.

§13. Complaints regarding the operation of the Website

1. The User has the right to submit a complaint regarding the operation of the Website. Complaints
may specifically concern:
1) inability to log in to the Website;
2) failures of the Website or its individual functionalities;
3) errors in the Website’s functionality.
2. Complaints may be submitted via email to Space to Grow or by traditional mail to the address of
Space to Grow, as specified in §2(6) of the Terms and Conditions.
3. A complaint should include a brief description of the issue, along with the complainant’s
identification and contact details.
4. Complaints will be reviewed within 14 days. The response will be sent to the User via the same
method the complaint was submitted or according to the User’s specified preference.

§14. Alternative Dispute Resolution for Complaints

1. Information on alternative dispute resolution methods for handling complaints and pursuing
claims, as well as the rules for accessing these procedures, is available at the offices and on the
websites of district (municipal) consumer ombudsmen, consumer protection organizations,
Provincial Trade Inspection Authorities, and on the website of the Office of Competition and
Consumer Protection.
2. After completing the complaint procedure, the Consumer has the following options for alternative
dispute resolution:
1) submitting a request to the Provincial Trade Inspection Authority for mediation in order to
amicably resolve the dispute between the Consumer and Space to Grow;
2) submitting a request to a permanent consumer arbitration court operating at the Trade
Inspection Authority for a resolution of the dispute arising from an agreement;
3) obtaining free assistance in resolving the dispute with Space to Grow from a district
(municipal) consumer ombudsman or a consumer protection organization, such as the
Consumer Federation or the Polish Consumers’ Association. Consumer advice is provided by
the Consumer Federation via the Consumer Helpline at 801 440 220 or 222 66 76 76 (charges
apply according to the operator’s tariff) and via email at porady@dlakonsumentow.pl.
3. A list of institutions handling alternative consumer dispute resolution, along with the types of
cases they cover, is available on the website of the Office of Competition and Consumer
Protection at www.uokik.gov.pl.
4. The European Consumer Centres Network (ECC-Net) assists in resolving cross-border disputes.
The contact details of these institutions can be found on the website of the European Consumer
Centre at www.konsument.gov.pl.
5. The Consumer may also use the Online Dispute Resolution (ODR) platform, in accordance with
Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, on
online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and
Directive 2009/22/EC (Regulation on ODR in consumer disputes). The ODR platform is available
at http://ec.europa.eu/consumers/odr/ and serves as a single access point for consumers and
businesses to resolve disputes related to contractual obligations arising from online agreements
through alternative dispute resolution.
6. The use of out-of-court methods of handling complaints and pursuing claims is voluntary and can
only take place if both parties to the dispute, i.e. Space to Grow and the User, agree to it.

§15. Amendments and validity of the Terms and Conditions

1. The Terms and Conditions may be amended for important reasons, including:
1) changes in legal regulations that directly affect the content of the Terms and Conditions;
2) the introduction of new features or services on the Website, to the extent that such changes
impact the implementation of these Terms and Conditions;
3) changes to the details of Space to Grow, including its address, name, legal form, email address,
or phone number;
4) decisions or rulings issued by competent state authorities that affect or may affect the content
of the Terms and Conditions or the operation of the Website;
5) Force Majeure, to the extent that such changes impact the implementation of these Terms and
Conditions.
2. Space to Grow will inform Users of any amendments by publishing a relevant notice on the
Website and sending an email notification to Users with an active account.
3. Amendments to the Terms and Conditions will not affect services provided before the amendments
take effect. Such services remain subject to the Terms and Conditions in force at the time contract
for the provision of services was concluded.
4. The amended Terms and Conditions will come into effect 14 days after the date of notification.

§16. Final provisions

1. Any matters not regulated by these Terms and Conditions shall be governed by the applicable
provisions of Polish law, in particular the Civil Code and the Act on the Provision of Electronic
Services.
2. Any disputes arising from these Terms and Conditions or agreements concluded with Space to
Grow based on them shall be resolved by a Polish court having jurisdiction over Space to Grow’s
registered office.
3. The provisions of paragraph 2 of this paragraph does not apply to Consumers if mandatory legal
provisions provide otherwise.
4. The Terms and Conditions shall enter into force on 12.03.2025.
